Le poste de conseiller juridique principal est responsable de fournir des conseils juridiques et de gérer les services juridiques à l'entreprise en matière de gouvernance des données, de droit de la vie privée, d'intelligence artificielle (IA) et d'innovation numérique, ainsi que du droit réglementaire. La personne titulaire du poste jouera un rôle clé pour veiller à ce que les initiatives technologiques et les stratégies de données de McKesson Canada soient conformes à ses politiques, à ses objectifs et aux lois applicables. Plus précisément, le conseiller juridique principal :
Fournir des conseils juridiques et des orientations à l'entreprise sur ses stratégies de données au fur et à mesure de leur évolution, en tenant compte des objectifs commerciaux, des obligations contractuelles et des considérations de confidentialité et de gestion des données, y compris le respect des lois fédérales et provinciales applicables sur la vie privée telles que la LPRPDE (PIPEDA) et la Loi 25 du Québec;
Travailler en collaboration avec les dirigeants d'affaires et fonctionnels pour établir un cadre juridique stratégique afin de produire, gérer et exploiter les aperçus tirés des données afin d'alimenter les services de McKesson Canada en conformité avec les lois fédérales et provinciales applicables, y compris la réglementation en matière de santé, la législation sur la vie privée et les politiques d'entreprise;
Fournir des conseils pour permettre aux équipes d'affaires de fournir des services aux clients de McKesson en conformité avec les lois sur les soins de santé et les codes de conduite professionnelle

Responsabilités spécifiques:
Travailler en étroite collaboration avec le groupe Données et analytique d'affaires, Stratégie et développement d'affaires, ainsi que le groupe Digital and Data Assets pour développer et faire évoluer les stratégies de données de McKesson afin de produire des aperçus d'affaires et de la clientèle ;

Soutient les dirigeants d'affaires et fonctionnels par une formation pertinente afin d'assurer la compréhension des lois et règlements en matière de soins de santé et de permettre la prise de mesures appropriées ;
Exercer d'autres fonctions juridiques pouvant raisonnablement être demandées par le vice-président, Affaires réglementaires, conformément au rôle de conseiller juridique principal
Assurer la prestation en temps opportun des services juridiques nécessaires à la gestion quotidienne des activités de l’entreprise;
Participer à la rédaction, à la révision et à la mise en œuvre des politiques clés liées à la stratégie de données et à la réglementation, des positions juridiques et des cadres de conformité ;
Conseiller sur des questions juridiques liées à la vie privée (y compris le respect de la LPRPDE (PIPEDA), de la Loi 25 du Québec et d'autres lois applicables sur la vie privée), la gouvernance et la stratégie des données, l'intelligence artificielle et les questions réglementaires ;
Fournit des conseils juridiques stratégiques concernant les demandes d'accès à l'information (ATI), la confidentialité et les enquêtes réglementaires;
Veiller à ce que les politiques juridiques et de conformité de l'entreprise soient mises en œuvre et maintenues en collaboration avec le Bureau de la protection de la vie privée et de la conformité (PCO), et fournir des conseils juridiques sur l'interprétation et l'application de ces politiques;
Participe à des équipes interfonctionnelles pour traiter des projets spéciaux, tels que la mise en œuvre de lois, le développement de nouveaux services ou produits et la gestion des risques;
Suivre l'évolution de la législation et des normes de l’industrie liées à l'IA, à l'automatisation et aux technologies numériques afin d'assurer une conformité proactive;

Collaborer avec les équipes TI, de conformité et les unités d’affaires pour aligner les exigences légales sur les objectifs d'innovation et d'automatisation;
Compétences critiques:
Expérience juridique : Expertise en droit réglementaire, vie privée, transactions technologiques et en gouvernance de l'IA. Un mélange d'expérience en cabinet d'avocats et en entreprise, constitue un atout . Le candidat retenu doit posséder un dossier éprouvé d'accomplissements en tant qu'avocat(e) doté d'une solide expertise technique juridique et qui, au besoin, peut aussi retrousser ses manches et se concentrer sur les détails d'un dossier en tant que contributeur individuel. Capacité à penser de façon analytique et créative et à résoudre des problèmes, avec un accent sur des approches globales de gouvernance des données, de stratégie des données et d'innovation numérique. Capacité à anticiper les tendances et les conséquences futures, particulièrement en matière de l'IA et des technologies émergentes; posséder une connaissance et une perspective juridiques larges et approfondies.
Compétences interpersonnelles et d'influence efficaces : Pour réussir, l'avocat dans ce rôle doit être capable de mettre en œuvre de manière proactive des stratégies juridiques au sein d’une organisation hautement matricielle, particulièrement dans le cadre d’initiatives technologiques et d'innovation interfonctionnelles. Exigences du poste:
Un diplôme en droit d'une université reconnue.
Membre du Barreau du Québec ou de l'Ontario, avec 5 à 8 ans d'expérience en droit réglementaire acquise en cabinet et/ou en pratique privée.
Les éléments suivants sont considérés comme des atouts : expérience pertinente dans les secteurs de la santé ou du commerce de détail, expérience en gouvernance de l'IA, en contrats technologiques et dans les environnements réglementés, ainsi que la détention d’une certification IAPP.
Capacité à peser et à équilibrer le risque juridique avec les objectifs d'affaires.
Compétences efficaces en collaboration et en leadership.
Le bilinguisme anglais et français est un atout majeur.

Work Arrangement: This is a hybrid position requiring candidates to work on-site at least 2 days per week at our designated office location. The remaining days may be worked remotely, subject to team and business needs.
The Chief Counsel position is responsible for providing legal counsel and managing legal services to the Company on data governance, privacy law, artificial intelligence (AI) and digital innovation, and regulatory law matters. They will be a key player in ensuring McKesson Canada’s technology initiatives and data strategies are in compliance with its policies, objectives, and applicable laws. More specifically, the Chief Counsel will:
Provide legal advice and guidance to the Company on its data strategies as they evolve, taking into consideration commercial objectives, contractual obligations, and privacy and data management considerations, including compliance with applicable federal and provincial privacy legislation such as PIPEDA and Quebec's Law 25
Work collaboratively with business and functional leaders to establish a strategic legal framework to produce, manage, and leverage data insights to power McKesson Canada’s services in compliance with applicable federal and provincial laws, including healthcare regulations, privacy legislation, and corporate policies
Provide counsel to enable business teams to provide services to McKesson’s customers in compliance with health care laws and professional codes of conduct
Build and maintain key relationships across the business and be a valued business partner
Collaborate and consult effectively with other corporate functions including McKesson’s Digital and Data Assets group to align on enterprise initiatives where applicable
Provide legal guidance for artificial intelligence (AI) and digital innovation initiatives, ensuring regulatory compliance with applicable Canadian laws including PIPEDA and emerging AI regulations, data privacy protection, and ethical deployment of AI-enabled tools in healthcare and corporate operations in accordance with recognized AI ethics frameworks
Collaborate on the development of governance frameworks and risk management strategies for AI and digital transformation initiatives, including conducting risk assessments and implementing mitigation strategies
Demonstrate the highest integrity consistent with I2CARE and ILEAD principles and will act as a role model for professional and ethical behaviour
Specific Responsibilities:
Work closely with the Business Data and Analytics, Strategy and Business Development, and Digital and Data Assets groups to develop and evolve McKesson’s data strategies to produce business and customer insights
Collaborate with business unit leaders to learn business needs and ensure implementation and compliance with data strategies in compliance with privacy laws, records and information management policies, and related corporate positions
Supports business and functional leaders with relevant training to ensure understanding of health care laws and regulations in order to take appropriate actions
Carry out other legal duties as may be reasonably requested by the Vice President, Regulatory Affairs, consistent with the role of Chief Counsel
Ensure the timely provision of legal services required for the day-to-day management of business activities
Participate in the drafting, review, and implementation of key data strategy-related and regulatory policies, legal positions, and compliance frameworks
Advise on legal issues related to privacy (including compliance with PIPEDA, Quebec's Law 25, and other applicable privacy legislation), data governance and strategy, artificial intelligence, and regulatory matters
Provides strategic legal counsel in relation to access to information (ATI) requests, privacy, and regulatory investigations
Ensure that Company legal and compliance policies are implemented and maintained in collaboration with the Privacy and Compliance Office (PCO), and provide legal guidance on policy interpretation and application
Participates in cross-functional teams to address special projects, such as implementation of legislation, new services or products and risk management
Monitor evolving legislation and industry standards related to AI, automation, and digital technologies to ensure proactive compliance
Create and maintain internal policies on responsible data use and digital platforms, and emerging technology deployment
Partner with IT, compliance, and business teams to align legal requirements with innovation and automation goals
Critical Skills:
Legal Experience: Expertise in regulatory law, privacy, technology transactions, and AI governance. A mix of law firm and in-house experience is a plus. The successful candidate must have a proven track record of accomplishment as a lawyer with strong technical legal expertise and who, when required, can also roll up their sleeves and focus on the details of a matter as an individual contributor. Ability to think analytically and creatively and to problem solve, with a focus on comprehensive approaches to data governance, data strategy, and digital innovation. Anticipates future trends and consequences, particularly in AI and emerging technologies; has broad and deep legal knowledge and perspective.
Effective Interpersonal and Influencing Skills: In order to be successful, the lawyer in this role must be able to proactively implement legal strategies in a highly matrixed organization, particularly in cross-functional technology and innovation initiatives. The person in this role must demonstrate McKesson’s I2CARE values of Integrity, Inclusion, Customer First, Accountability, Respect and Excellence in day-to-day workplace interactions.
Position Requirements:
Law degree from a recognized university;
Member of the Quebec or Ontario Bar, with 5-8 years regulatory law experience acquired in-house and/or in private practice
The following are considered assets: relevant experience in the health or retail sectors, experience with AI governance, technology contracting, and regulated environments, and IAPP certification
Ability to weigh and balance legal risk with business goals
Effective collaboration and leadership skills
English and French bilingualism a strong asset
