Work Arrangement: This is a hybrid position requiring candidates to work on-site at least 2 days per week at our designated office location. The remaining days may be worked remotely, subject to team and business needs.

The Chief Counsel position is responsible for providing legal counsel and managing legal services to the Company on data governance, privacy law, artificial intelligence (AI) and digital innovation, and regulatory law matters. They will be a key player in ensuring McKesson Canada’s technology initiatives and data strategies are in compliance with its policies, objectives, and applicable laws.  More specifically, the Chief Counsel will:

  • Provide legal advice and guidance to the Company on its data strategies as they evolve, taking into consideration commercial objectives, contractual obligations, and privacy and data management considerations, including compliance with applicable federal and provincial privacy legislation such as PIPEDA and Quebec's Law 25

  • Work collaboratively with business and functional leaders to establish a strategic legal framework to produce, manage, and leverage data insights to power McKesson Canada’s services in compliance with applicable federal and provincial laws, including healthcare regulations, privacy legislation, and corporate policies

  • Provide counsel to enable business teams to provide services to McKesson’s customers in compliance with health care laws and professional codes of conduct

  • Build and maintain key relationships across the business and be a valued business partner

  • Collaborate and consult effectively with other corporate functions including McKesson’s Digital and Data Assets group to align on enterprise initiatives where applicable

  • Provide legal guidance for artificial intelligence (AI) and digital innovation initiatives, ensuring regulatory compliance with applicable Canadian laws including PIPEDA and emerging AI regulations, data privacy protection, and ethical deployment of AI-enabled tools in healthcare and corporate operations in accordance with recognized AI ethics frameworks

  • Collaborate on the development of governance frameworks and risk management strategies for AI and digital transformation initiatives, including conducting risk assessments and implementing mitigation strategies

  • Demonstrate the highest integrity consistent with I2CARE and ILEAD principles and will act as a role model for professional and ethical behaviour

Specific Responsibilities:

  • Work closely with the Business Data and Analytics, Strategy and Business Development, and Digital and Data Assets groups to develop and evolve McKesson’s data strategies to produce business and customer insights

  • Collaborate with business unit leaders to learn business needs and ensure implementation and compliance with data strategies in compliance with privacy laws, records and information management policies, and related corporate positions

  • Supports business and functional leaders with relevant training to ensure understanding of health care laws and regulations in order to take appropriate actions

  • Carry out other legal duties as may be reasonably requested by the Vice President, Regulatory Affairs, consistent with the role of Chief Counsel

  • Ensure the timely provision of legal services required for the day-to-day management of business activities

  • Participate in the drafting, review, and implementation of key data strategy-related and regulatory policies, legal positions, and compliance frameworks

  • Advise on legal issues related to privacy (including compliance with PIPEDA, Quebec's Law 25, and other applicable privacy legislation), data governance and strategy, artificial intelligence, and regulatory matters

  • Provides strategic legal counsel in relation to access to information (ATI) requests, privacy, and regulatory investigations

  • Ensure that Company legal and compliance policies are implemented and maintained in collaboration with the Privacy and Compliance Office (PCO), and provide legal guidance on policy interpretation and application

  • Participates in cross-functional teams to address special projects, such as implementation of legislation, new services or products and risk management

  • Monitor evolving legislation and industry standards related to AI, automation, and digital technologies to ensure proactive compliance

  • Create and maintain internal policies on responsible data use and digital platforms, and emerging technology deployment

  • Partner with IT, compliance, and business teams to align legal requirements with innovation and automation goals

Critical Skills:

  • Legal Experience: Expertise in regulatory law, privacy, technology transactions, and AI governance. A mix of law firm and in-house experience is a plus. The successful candidate must have a proven track record of accomplishment as a lawyer with strong technical legal expertise and who, when required, can also roll up their sleeves and focus on the details of a matter as an individual contributor.  Ability to think analytically and creatively and to problem solve, with a focus on comprehensive approaches to data governance, data strategy, and digital innovation. Anticipates future trends and consequences, particularly in AI and emerging technologies; has broad and deep legal knowledge and perspective. 

  • Effective Interpersonal and Influencing Skills: In order to be successful, the lawyer in this role must be able to proactively implement legal strategies in a highly matrixed organization, particularly in cross-functional technology and innovation initiatives.  The person in this role must demonstrate McKesson’s I2CARE values of Integrity, Inclusion, Customer First, Accountability, Respect and Excellence in day-to-day workplace interactions. 

Position Requirements:

  • Law degree from a recognized university;

  • Member of the Quebec or Ontario Bar, with 5-8 years regulatory law experience acquired in-house and/or in private practice

  • The following are considered assets: relevant experience in the health or retail sectors, experience with AI governance, technology contracting, and regulated environments, and IAPP certification

  • Ability to weigh and balance legal risk with business goals 

  • Effective collaboration and leadership skills

  • English and French bilingualism a strong asset

The pay range shown below is aligned with McKesson's pay philosophy, and pay will always be compliant with any applicable regulations. $113,500 - $189,100
